Terms of Service

1. Agreement and eligibility

These Terms govern the Omuuz website, accounts, store, purchases, licenses, downloads, and support. By using account features or completing a purchase, you agree to these Terms and the Privacy Policy. If you do not agree, do not use those features.

You must be legally able to enter a binding agreement where you live. If you act for an organization, you represent that you can bind it. Mandatory rights under applicable law are not waived.

2. Accounts

You must provide accurate information, protect access to your email and linked Google account, and promptly report suspected unauthorized use. You may not transfer an account or impersonate another person.

3. Products and orders

Each product page states the applicable platform, compatibility, license type, device limit, price, release status, privacy boundary, and material limitations. Those facts form part of the purchase terms.

You must sign in before purchase. Stripe processes checkout. An order is accepted only after Omuuz receives a verified successful payment event and creates the order and license; a browser success page alone does not prove payment.

Prices, currency, and applicable taxes are displayed before payment. Report duplicate, unauthorized, failed, or incorrect charges to mhzever@gmail.com.

4. Software license

Unless a product page states otherwise, a purchase grants a limited, non-exclusive, non-transferable license to install and use the software on the number of your own compatible devices shown at purchase. Software is licensed, not sold.

You may not resell, sublicense, share license credentials, bypass activation or device limits, violate law or others' rights, or reverse engineer except where applicable law prohibits that restriction.

5. Delivery, activation, and updates

Software, license details, and private download access are delivered to your account and/or verified email. Some products require a connection for activation, device changes, license status, or private updates; product pages state their offline boundary.

A lifetime license means continued use of the purchased major version under its stated terms. It does not promise perpetual feature updates, compatibility with every future operating system, or indefinite operation of third-party infrastructure.

6. Refunds

Direct Omuuz purchases are covered by the Refund Policy. The standard voluntary request period is seven calendar days from purchase. A refund revokes the associated license and private download entitlement. Mandatory legal rights remain available.

7. Acceptable use

• Do not interfere with, overload, probe, or bypass security or access controls.
• Do not automate accounts, checkout, activation, scraping, or downloads abusively.
• Do not transmit malware, unlawful material, or content that infringes others' rights.
• Do not use Omuuz, software, or licenses for fraud, resale, unauthorized sharing, or unlawful activity.

8. Intellectual property and third parties

Omuuz, product names, software, site design, and documentation are protected by intellectual-property laws. These Terms do not transfer ownership. Voluntary feedback may be used to improve Omuuz without compensation, but Omuuz does not gain ownership of your personal files.

Google, Stripe, Cloudflare, and other providers have their own terms for services they control. This does not remove responsibilities that applicable law places on Omuuz.

9. Changes, suspension, and termination

We may maintain or change site features and may suspend access to protect users, investigate abuse, comply with law, or address security and operational risks. Where reasonably possible, we will notify users of material adverse changes to purchased functionality.

An account may be suspended for a material violation. This does not eliminate payment, refund, privacy, or consumer obligations.

10. Disclaimers and liability

To the extent permitted by law, services and software are provided as available without warranties not expressly stated on the product page. We do not promise uninterrupted operation, error-free software, or compatibility with every device, update, file system, or third-party service. Non-excludable legal warranties and remedies remain available.

To the extent permitted by law, Omuuz is not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, data, or opportunities. Where liability may be limited, aggregate liability for a paid product will not exceed the amount paid for that product in the prior twelve months. This does not apply to liability that cannot legally be limited.

11. Disputes, changes, and contact

Contact mhzever@gmail.com first so we can try to resolve a concern. These Terms do not require arbitration or choose a jurisdiction with no meaningful connection to you or Omuuz. Ordinary conflict-of-law and consumer rules, including mandatory local rights, determine applicable law and forum.

We may update these Terms prospectively. Material changes will have a new effective date and additional notice where required. The Terms shown at purchase continue to govern that transaction unless law requires otherwise or you accept a later change.
